Please read this User Agreement and Terms of use carefully before using the KidsCrafts.shop e-learning platform and marketplace at https://kidscrafts.shop. This Agreement sets forth the terms and conditions that govern your use of the platform and marketplace. By accessing or using KidsCrafts.shop, or KidsCrafts iOS app, or KidsCrafts Android app (thereafter KidsCrafts.shop), you agree to be bound by this Agreement. By accepting this User Agreement and Terms, you agree to verify that you are legally allowed to use KidsCrafts.shop in your location, and that this User Agreement and Terms, as well as other KidsCrafts.shop policies, comply with your local laws. If you do not agree to these terms, please do not use the platform or the apps.
2. About KidsCrafts.shop
KidsCrafts.shop is an e-learning platform that allows children sell only under legally responsible adults observations a variety of crafts they've made in various geographic locations while learning about financial literacy and acquiring diverse uptaning interprenetial skills and more. KidsCrafts.shop is not a party to contracts for sale between third-party sellers and buyers, nor is KidsCrafts.shop a traditional auctioneer.
3. User Eligibility
3.1. KidsCrafts.shop is intended for use by children with the consent and supervision of their parents (hereafter parents or legal guardians are the Sellers who control and observe all the minors' activities) who are legally responsible or legal guardians.
3.2. Parents or legal guardians are responsible for the actions and conduct of minors using KidsCrafts.shop. They must ensure that the minor's use of the platform complies with this Agreement and any applicable laws and regulations.
4. Account Registration
4.1. To access certain features of KidsCrafts.shop, you may need to register an account. When registering, you agree to provide accurate, current, and complete information about yourself or the minor for whom you are registering.
4.2. All accounts should be registered under adult supervision and legally belong to adults aged 18 or above, in accordance with the local laws required to sell or buy online.
4.3. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must promptly notify KidsCrafts.shop of any unauthorized use of your account or any other breach of security.
4.4. The email address on the account must belong to a parent or legal guardian
4.5. The project has a referral program. When a new vendor registers through the referral link of an already active seller, the latter is paid a bonus. Bonus of 5 dollars is paid once when the referred vendor has made sales of 100 or more dollars.
5. User Conduct
5.1. When using KidsCrafts.shop, you agree to comply with all applicable laws and regulations. You must not use the platform for any unlawful, fraudulent, or unauthorized purposes.
5.2. You agree not to engage in any of the following and other prohibited activities:
- Violating any intellectual property rights or other proprietary rights of KidsCrafts.shop or third parties.
- Uploading, posting, or transmitting any content that is unlawful, harmful, defamatory, abusive, or otherwise objectionable.
- Interfering with or disrupting the operation of KidsCrafts.shop or the servers or networks connected to the platform.
- Causing harm or damage to any person or entity.
- Any other prohibited by local law or other countries law.
6. Intellectual Property
6.1. KidsCrafts.shop and its content, including but not limited to logos, trademarks, images, text, graphics, and software (collectively the “Content”) found through the Website are owned or licensed by KidsCrafts.shop and may not be used, copied, broadcast, distributed, uploaded, posted or shared in any way without the express written consent of KidsCrafts.shop.
6.2. KidsCrafts.shop expressly reserves all intellectual property rights in the Content. Nothing contained on the Website grants or should be construed as granting any license or right to use the Content for any purpose without the express written consent of KidsCrafts.shop.
7. Privacy Policy
All personal information we collect through the Website is subject to our Privacy Policy. By using the Website, you consent to all actions taken by KidsCrafts.shop with respect to your personal information in compliance with the Privacy Policy. 8. Funding
8.1. KidsCrafts.shop provides a platform for children to sell their handmade crafts and for buyers to purchase these crafts.
8.2. For Sellers are provided payments in the amount of 70% of the sale.
8.3. Payments will be credited to the bank account of the student’s parent or guardian after 30 days.
8.4 Sellers will be able to withdraw their funds when the minimum amount of 100 USD is reached.
8.5 The cost of the withdrawal fee is paid by the seller.
9. Buying and Selling Crafts
9.1. Selling and buying on KidsCrafts.shop is only permitted from accounts that have been registered and monitored by legally aged adults. These accounts are intended for educational purposes for minors, who will go through the entire process of operating the marketplace. The legally aged account owner is responsible and has agreed to review and approve all steps taken by minors. Placing and showcasing all items should be done by the account owner, who takes all responsibility for the listed item and its subsequent sale. Selling or buying on KidsCrafts.shop implies that both the buyer and the seller are legally aged persons entering into a direct contract to complete the transaction.
9.2. KidsCrafts.shop provides a platform to educate children by legally responsible parents or guardians of selling their crafts and for buyers to purchase these crafts.
9.3. KidsCrafts.shop does not guarantee the quality, safety, or legality of the crafts listed on the platform. Buyers are responsible for evaluating the crafts and determining their suitability.
9.4. Sellers are responsible for accurately representing their crafts and fulfilling their obligations to buyers, including shipping with shipping cost coverage the ordered items in a timely manner.
9.5. Parents or legal guardians are responsible for overseeing and assisting children in conducting transactions, ensuring the safety of the child, and providing necessary consent for their participation on the platform.
9.6. All billing information must belong to the parent or legal guardian responsible for the account.
10. Disclaimer of Liability
10.1. We are not responsible for the quality, accuracy, or safety of the crafts presented on the CidsCrafts.shop platform. We are not sellers and do not control transactions between users, and we are not liable for any claims, losses, or damages arising from transactions between users.
10.2. We are not liable for any errors, interruptions, delays, or data losses resulting from the use of the Website.
10.3. We do not provide any warranties regarding the availability, reliability, or security of the Website, or the absence of errors or viruses.
10.4 Any material viewed, downloaded or otherwise obtained through the use of the website is done at your own discretion and risk and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material, or use of the website. Information published at this site may refer to products, programs or services that are not available in your jurisdiction.
10.5 If fraud is detected, each incident will be reviewed individually to determine the responsible party.
11. Return and refund
11.1 By using the Website, you consent to all actions taken by KidsCrafts.shop in compliance with the Shipping & Returns Policy. For a detailed description of KidsCrafts.shop’s return and refund practices, please see our Shipping & Returns Policy, which is incorporated herein by reference.
11.2. Please note that returned products must be in the same condition as they were received, without any damage. If the returned items do not satisfy these requirements, your return will not be eligible for a refund or exchange. Keep in mind that if you choose to return the items via post or express services buyers will need to cover the shipping costs.
11.3. We commit to processing your return within 14 days of receiving the package. And you will get your refund after your returned products have been accepted in 30 days.
12. Applicable Law and Dispute Resolution
12.1. This Agreement shall be governedin accordance with the laws of British Columbia, Canada, without regard to its principles concerning conflicts of laws. All disputes, questions or differences whatsoever which shall at any time hereafter arise between the parties hereto (including the Company) or their respective representatives or any of them, and which the parties are unable to settle amicably between them, concerning or relating to this Agreement or the validity, construction, meaning, operation or effect thereof, or any clause herein contained, or as to the rights, duties or liabilities of the Parties hereto under or by virtue of this Agreement, shall be finally settled under the Commercial Arbitration Act of British Columbia, Canada. Arbitration proceedings shall take place in Vancouver, British Columbia, Canada.
12.2. Any disputes arising from the use of the Website shall be resolved in accordance with the laws of British Columbia, Canada.
13. Changes to Terms
From time to time, we may change these Terms to accommodate new technologies, industry practices, regulatory requirements or for other purposes in our sole discretion. You are advised to check the Terms regularly, as continued use is deemed to be approval of and consent to all such changes.
14. Changes to Website
We may update the content on the Website from time to time, but its content is not necessarily complete or up-to-date. The Website may be out of date, and KidsCrafts.shop makes no commitment to update the Website.
15. Entire Agreement
These Terms and the Privacy Policy constitute the entire integrated and exclusive agreement between you and KidsCrafts.shop with respect to the Website.
16. Termination of the Agreement
16.1. This Agreement can be terminated by KidsCrafts.shop unilaterally without notifying the other Party.
16.2. This Agreement can be terminated by the other Party after notifying KidsCrafts.shop via email.
